A sample of legal matters successfully resolved through our professional litigation services include:

  • Represented the Illinois Director of Insurance in his capacity as Liquidator of Reserve Insurance Company, an insolvent Illinois insurer.  This insolvency spawned complex civil RICO litigation in the Circuit Court of Cook County, the Federal District Court and the Bankruptcy Court.  Several related interlocutory appeals to the Seventh Circuit Court of Appeals and the U.S. Supreme Court were prosecuted successfully by members of the Firm.

  • Represented City of Chicago municipal pension funds in a series of settlements of their class action suit (consisting of approximately 40,000 class members) for retiree health care coverage, securing hundreds of millions of dollars of benefits for the funds and their members.

  • Represented the State of Illinois (as Special Assistant Attorneys General) and a class of 300,000 plaintiff/citizens against Panhandle Eastern Pipe Line Company for alleged anti-competitive behavior in central Illinois.  This case also involved successful interlocutory appeals on behalf of the State to the Court of Appeals and the U.S. Supreme Court.

  • Represented numerous employers public and private, including inter alia, the University of Illinois, MOA Hospitality, Inc., and the Metropolitan Pier and Exposition Authority, from claims under Title VII of the Civil Rights Act of 1964 for alleged discrimination based on race, national origin and gender under 42 U.S.C. §1983 and §1988, and for alleged deprivations of equal protection under the Fifth and Fourteenth Amendments to the Constitution of the United States, as well as claims alleging discrimination under the Equal Pay Act and the Americans with Disabilities Act.  The firm also has successfully represented discharged employees with claims under the Age Discrimination in Employment Act of 1967 and the Pregnancy Discrimination Act.

  • Represented a Chicago municipal pension fund in an appeal to the Illinois Supreme Court over an interpretation of the Pension Code that would have resulted in a potential $1.8 million unfunded liability to the fund.  The firm successfully petitioned the Supreme Court to hear the appeal, and then convinced the Court to overturn the Appellate Court decision adverse to the fund.

  • Represented the board of a leading financial institution, in connection with the embezzlement of millions of dollars by an officer.  The firm successfully represented the board in investigations by the Internal Revenue Service and the U.S. Attorneys Office.

  • Represented the Illinois Department of Transportation and the Illinois State Toll Highway Authority in thousands of eminent domain proceedings instituted in Cook, Will, DuPage and Kane Counties in respect to the acquisition of hundreds of millions of dollars of property for road and highway improvements.  The subject parcels were predominantly commercial in nature, many of which involved complex damage to remainder issues.

  • Represented various governmental agencies in collective bargaining, unfair labor practice disputes, arbitration and interest arbitration, and Illinois Labor Relations Board proceedings vis a vis AFSME, Teamsters and SEIU.

  • Represented a Chicago municipal pension fund in an appeal to the Illinois Appellate Court over an interpretation of the Pension Code that would have prevented the Retirement Board from denying a $50,000-a-year pension to a former firefighter-turned-arsonist.

  • Represented a state agency involving injunction and monetary damage claims of constitutional impairment of contracts in connection with the administration of an Employee IRS 403(b) plan.

  • Represented a multi-employer pension fund in ERISA claims against an investment advisor resulting in a seven figure settlement in favor of the pension fund.

  • Represented a multi-employer pension fund in defense against a six figure claim of an employee for wrongful discharge resulting in a grant of summary judgment in favor of the pension fund.

  • Represented a multi-employer pension fund in an ERISA claim against an investment advisor for losses resulting from investments in guaranteed investment contracts issued by Equitable Life Insurance Company made in contravention of pension fund investment guidelines.

  • Represented an investment advisor relating to claims by a government pension fund of breach of fiduciary duty and insider transactions. 

  • Represented numerous state and national banking institutions both in negotiated loan workouts and lawsuits involving hundreds of millions of dollars of real estate, construction, and commercial loan defaults.

  • Represented numerous state agencies and private employers in the defense of Title VII, ADA and ADEA employee claims.

  • Represented general contractors, owners and lenders in construction related suits, dealing extensively with litigation and/or settlement of large dollar mechanics’ lien claims.

  • Represented general contractor in a multi-million dollar contract claim against public owner and defended cross claims against contractor and surety for critical path violations and liquidated damages.

  • Represented large real estate developer in an ongoing dispute involving a number of complex issues regarding compliance with regulatory and municipal ordinances.

  • Represented a number of businesses in commercial contract disputes involving a wide variety of disputes including: breach of contract issues, land usage, enforcement of contractual payment clauses, mortgage and loan issues, encroachment of property, mortgage, commercial buy-sell agreement disputes.
